Before proceeding with your reservation or booking (hereafter used interchangeably), we kindly request that you thoroughly review the terms and conditions provided below.


Please be aware that any reservations you make constitute a legally binding agreement. This agreement applies not only to yourself but also to any travelers or passengers (hereafter used interchangeably) for whom you have made a booking. By making a reservation with Cranberry Tours, you signify your acceptance of, and agreement to, the following terms and conditions, and you commit to full compliance with them.


Acknowledgement

Applicable to all travelers


In accordance with the notice presented above, you hereby acknowledge that, whether you have personally made the reservation online or if the online booking was made on your behalf, you agree to the terms and conditions outlined herein. If the passenger is under 18 years of age, a parent or guardian of the passenger must also agree to these terms and conditions. By proceeding with the reservation, you confirm that you have read, understood, and accepted the terms and conditions, and you commit to abiding by them in full.


Payment and Cancellation Terms and Conditions

Online Credit Card Payment Policy

Cranberry Tours accepts payments through Mastercard, Visa credit cards, and debit cards. To facilitate secure online payments, we have established a direct connection with Stripe, a reputable payment processing and merchant services company founded in 2021. Stripe is accredited by the Better Business Bureau and maintains an exceptional A+ rating for your peace of mind. When you make an online payment with a Visa or MasterCard, please note that Cranberry Tours will appear as the vendor on your credit card statement.


By using this website, you express your agreement with our comprehensive Terms and Conditions, regardless of whether you have physically signed any credit card forms. Therefore, by authorizing Cranberry Tours to use your credit card for the payment of your Cranberry Tours vacation package, you confirm your commitment to pay the total amount specified for these services to your card issuer in accordance with your cardholder agreement. By providing authorization to use your credit card, you also acknowledge and accept the following Payment Terms and Conditions:


1. You affirm that all information submitted to Cranberry Tours regarding the transaction is accurate and complete, including, but not limited to, the details associated with your credit card.


2. You warrant to Cranberry Tours that you possess full authorization to utilize the credit card details for online transactions.


3. Cranberry Tours is not obliged to provide the Travel Package you have requested if there is any suspicion that you lack the proper authorization to use the provided credit card details, or if your credit card provider has informed Cranberry Tours that they will not honor these details for the transaction. Cranberry Tours is only obligated to supply the Travel Package once your credit card provider has granted authorization for the transaction.


4. It is strictly prohibited to engage in any form of misleading, deceptive conduct, or fraudulent activity when utilizing this service.


5. You are required to adhere to all applicable laws, rules, regulations, standards, or codes of practice governing this service. You indemnify Cranberry Tours, its employees, contractors, and agents against any losses, costs, or damages they may incur as a result of your violation of any of these terms and conditions.


6. You agree to comply with any requirements stipulated by your credit card provider that pertain to the use of this online service, including, but not limited to, staying within any transaction limits imposed on your credit card. You must provide Cranberry Tours with any offline identity verification, proof of your right to use the credit card, and transaction details as may be requested by Cranberry Tours from time to time.


Declined Credit Cards

In the event of a declined authorization on the provided credit card, we will make every effort to promptly notify you. We will reach out using the contact information, including the email address and/or phone number, that you have supplied during the booking process. Please be aware that if the credit card authorization is declined, the reservation will regrettably be canceled. Depending on availability, a new reservation will need to be made.


Payment Schedule

To secure your booking, a deposit equivalent to 20% of the purchase price per passenger is required at the time of booking. The remaining balance will be automatically charged to your credit card 14 days prior to the departure date for any destination.


Pricing

All prices are denominated in Canadian funds and include applicable taxes, unless otherwise expressly stated.


Exclusions

Expenses of a personal nature, such as room service, beverages, telephone charges, laundry services, special dietary requests, and any meals not explicitly specified in the tour itinerary, are not covered by the tour package. Passengers are responsible for these additional costs.


Gratuities

Tipping is a wonderful way to express your appreciation for the excellent service provided by our tour directors, drivers, step-on guides, and waitstaff. Gratuities are entirely at your discretion and are not included in the published tour prices.


Refunds for Unused Travel Services

No refunds will be issued for travel services that remain unused during the tour.


Itinerary Subject to Change

Please be advised that all tour itineraries are subject to modification without prior notice. In the event of an itinerary change during the tour, passengers will not be eligible for refunds.


Cancellation and Change Fees for Tours

Cranberry Tours retains the right to alter tour itineraries, both before and during the tour, to enhance passenger comfort and overall enjoyment. In the event of any increased costs resulting from such changes, passengers are responsible for covering these expenses. Conversely, if changes lead to a reduction in costs, passengers will receive a corresponding refund. 


Furthermore, Cranberry Tours reserves the prerogative to reject any individual as a tour member at any time, either before or during the tour, should their presence be deemed detrimental to the interests, comfort, or enjoyment of fellow passengers. Additional terms and conditions also apply:


Payment, Date Changes, and Refunds

A non-refundable deposit of 20% of the total purchase price is required upon booking. Additionally, a service fee of $50 per person applies to date changes. Please note that date changes are not permitted within 10 days before the departure of all Montreal, Quebec, and Ottawa tours or within 61 days before the departure of any tour.


Once the full balance has been charged, the tour package becomes 100% non-refundable.


If passengers require a name or date change, a service fee of $50 per person will apply. However, name changes are not allowed within 10 days or less before the departure of all Montreal, Quebec, and Ottawa tours.


In cases where our buses are unable to operate due to extreme weather conditions, acts of terrorism, or acts of God prior to departure, passengers will receive a partial refund, excluding the 20% deposit per person.


Please be aware that in the event of extreme weather conditions, acts of terrorism, or acts of God occurring during the tour, refunds will not be issued.


Cranberry Tours cannot be held responsible for any attraction tickets purchased in advance if a tour date is canceled.


Our Policies and Conduct Guidelines

We kindly ask for your understanding that we are unable to make exceptions to the policies outlined above. To safeguard against any financial losses, we strongly advise you to consider purchasing comprehensive travel insurance.


At Cranberry Tours, we maintain a strict zero-tolerance policy concerning disrespectful, belligerent, or discourteous conduct directed towards fellow passengers, drivers, guides, and all Cranberry Tours staff. If, regrettably, any passenger engages in such behavior, Cranberry Tours reserves the right to promptly remove the passenger from the tour, without any refund. Additionally, the passenger will be held responsible for arranging and covering the costs of their own transportation back home.



Insurance Terms and Conditions

Travel Insurance

Cranberry Tours strongly advises all tour participants to consider purchasing travel insurance. Please note that the tour package prices do not include travel insurance. While we hope for a safe and enjoyable journey, unforeseen accidents or circumstances can occur. Cranberry Tours does not assume liability for any accidents that may happen during the tour. We highly recommend that you arrange suitable travel insurance coverage that, at a minimum, includes provisions for trip cancellation and emergency medical assistance, including repatriation, in the event of accidents or illnesses while traveling abroad.


Cranberry Tours does offer the option to purchase travel insurance at the time of booking. However, please be aware that Cranberry Tours acts solely as a facilitator in this regard and is not an agent of the insurer. We do not provide representations or warranties concerning the specific coverage you select.


It is your responsibility to ensure that the insurance coverage you choose aligns with your specific requirements, whether you opt for insurance through Cranberry Tours or from an external provider. Additionally, it is your duty to fully disclose all relevant information to your insurance provider, including any pre-existing medical conditions. We recommend reaching out to your chosen insurance company for comprehensive details and guidance on your insurance options.


Terms and Conditions of Liability

Liability of Suppliers

Cranberry Tours collaborates with various third-party suppliers who offer travel services such as ground transportation, accommodations, cruises, guides, and dining establishments. It's essential to note that Cranberry Tours cannot be held responsible for the actions or oversights of these third-party suppliers, their employees, representatives, or agents.


Liability of Cranberry Tours

Cranberry Tours explicitly disclaims any liability for claims, losses, damages, costs, or expenses stemming from personal injuries, accidents, deaths, losses, damages, delays, inconveniences, diminished enjoyment, emotional distress, whether physical or psychological. Both Cranberry Tours and its passengers understand and agree that Cranberry Tours holds no responsibility for the following, among other things:


1. Actions or omissions by third-party suppliers, including but not limited to ground transportation providers, airlines, hotels, restaurants, or their employees, representatives, or agents.


2. Actions or omissions by fellow passengers traveling on the same tour.


3. Unforeseen circumstances such as illness, family emergencies, theft, or other personal situations affecting individual travelers.


4. Force Majeure events that are beyond our control.


5. Actions or omissions by passengers, their insurers, brokers, or any other parties related to travel insurance.


6. Government actions, weather conditions, equipment failures, labor disputes, illnesses, theft, or any other factors beyond our direct control.


7. Failure of a passenger to obtain required documentation or comply with health regulations necessary for their travel arrangements.


8. Failure of a passenger to follow provided instructions.


9. Issues that may arise during border crossings.


10. Delays, missed connections, losses, damages, injuries to persons or property, mechanical defects or failures, however caused, or substitutions of hotels or carrier equipment beyond Cranberry Tours' control, along with any additional expenses resulting from such situations.


11. Any discomfort, diminished enjoyment, upset, disappointment, distress, or frustration, whether physical or psychological, however caused.


12. Cancellation of a tour by Cranberry Tours, provided that a full refund of all payments made is issued to the passenger. Please be aware that all tour itineraries are subject to change without prior notice. Cranberry Tours reserves the right to make alterations before or during the tour to enhance the comfort and enjoyment of passengers. It is mutually agreed that any cost increases resulting from such changes will be the responsibility of the passengers, while any cost reductions will be refunded to the passenger. Cranberry Tours also retains the right to decline any person as a tour member at any time, before or during the tour, if their presence is considered detrimental to the comfort and enjoyment of other passengers.



Waiver and Assumption of Risk

By submitting an online booking, passengers acknowledge, agree, and fully understand that their reservation may entail various risks, potential dangers, injuries, losses, and even the risk of death. Passengers on the booking willingly accept and assume all such risks and acknowledge their responsibility for any resulting losses, costs, or damages incurred during their participation in the tour. This applies whether the passenger personally made the booking or if it was made on their behalf.


Upon submitting an online booking, passengers hereby release and discharge Cranberry Tours, as well as its directors, agents, owners, officers, employees, and representatives, from any and all liability, claims, demands, losses, or damages that may arise during or as a result of the tour, regardless of whether the passenger personally made the booking or if it was arranged on their behalf.


Indemnity

All passengers, and in the case of passengers under 18, their parents or guardians, agree to indemnify Cranberry Tours, its employees, agents, and other representatives from any costs, damages, losses, injuries, or loss of life related to the tour package or any activities associated with it.


Reporting of Incidents

Irrespective of Cranberry Tours' liability, any incidents, injuries, issues, or dissatisfaction must be promptly reported to Cranberry Tours at 1-888-964-2293 during the event or as soon as possible afterward. This notification allows Cranberry Tours an opportunity to provide assistance and address any concerns.

Cranberry Tours places great importance on safeguarding your privacy. This privacy policy outlines the principles and practices governing the collection of personal information from users accessing our services via our website or through telephone and email communications.


Our commitment to you is encapsulated in the following:


Purpose and Consent: Prior to collecting your Personal Information, or during the collection process, we will clarify the purpose behind collecting it and obtain your consent.


Limiting Collection: Our collection of Personal Information remains reasonable under the circumstances, and your information will only serve the intended purpose for which it was gathered.


Security: We uphold the confidentiality and security of your personal information, ensuring that it remains undisclosed to entities beyond our group of companies and carefully selected third-party service providers/business partners, unless otherwise mandated by law or with your explicit consent.


Access: You retain the right to access your Personal Information and correct any inaccuracies.


We encourage you to periodically review this privacy policy, as we may update it when necessary.


Personal Information

We pledge to use and disclose your personal information solely for the purposes it was collected, except when your prior consent is obtained or when required by law. Any personal information, such as special needs, dietary or religious requirements, travel itinerary, addresses of your accommodation during the trip, etc., will only be shared with relevant suppliers involved in your travel arrangements and other essential parties required for the provision of your travel services, such as public authorities, customs, or immigration, if mandated by them or by law. Exceptions to this will only occur with your prior consent or as permitted or required by law. Moreover, we will retain your information only for the duration necessary to fulfill the purposes for which it was collected.


For inquiries or concerns regarding these statements, please call 1-888-964-2293. We are committed to addressing all reasonable concerns or inquiries in a timely manner.


Confirmation: Upon receiving your reservation and payment, you will receive all confirmation vouchers through email or, upon request, via regular mail in the form of an invoice.


Seat Assignment

Cranberry Tours handles all seat assignments, which are allocated on a first-come, first-served basis.


Baggage

Each passenger is permitted one suitcase and one small carry-on bag. While every effort is made to handle luggage with care, Cranberry Tours cannot be held responsible for any damage or loss. Baggage and personal belongings are the sole responsibility of their owners at all times.


Children

Children must be at least 5 years old to travel.


Travellers with Special Needs

Passengers requiring specific assistance must travel with a qualified companion as our drivers and guides cannot provide individualized support for walking, dining, boarding/disembarking from transportation, or other personal needs. Our coaches do not have wheelchair ramps, so all tour members must be able to ascend 3 or 4 steps onto the coach. Passengers with unique requirements should inform Cranberry Tours during booking. While we will make reasonable efforts to accommodate special needs, we are not liable for services denied by our suppliers.


Travel Etiquette

Cranberry Tours maintains a zero-tolerance policy for disrespectful or belligerent behavior. In such cases, offending passenger(s) will be removed from the tour with no refund, and they are responsible for their return transportation.


Smoking

Smoking is strictly prohibited on the coach and at hotels. All hotel properties enforce smoke-free policies, and passengers must adhere to these policies, which vary for each hotel.


Hotel Changes

Should the reserved accommodation become unavailable for any reason, we reserve the right to substitute it with a hotel of a similar category. This provision does not apply to major changes as outlined in the "Responsibility" section or to changes in hotels due to circumstances beyond our control.

Special Hotel Requests

For any specific hotel requests, such as room location or bed preferences, kindly make these requests at the time of booking. While Cranberry Tours will make every effort to accommodate such requests, we cannot be held responsible if, for any reason, these requests cannot be fulfilled.


Governing Law

This agreement is subject to the laws of the Province of Ontario. By agreeing to these terms and conditions, you also consent to the jurisdiction of this province in the event of any dispute.



By making a reservation with Cranberry Tours, I confirm that I have thoroughly reviewed and comprehended the TERMS AND CONDITIONS,  I am at least 18 years old, and on behalf of all passengers for whom I have made the booking, I hereby agree to be bound by and adhere to the Terms and Conditions. Additionally, I authorize Cranberry Tours to charge my credit card, as provided above, with the specified payment amount.
